The minutes of the meeting held on 2 February 2016 were taken as read and signed by the Chair as a correct record.

Local Government (Access to Information) Act 1985 - Exclusion of Press and Public

To pass the following resolution:

RESOLVED that, under Section 100A (4) of the Local Government Act 1972, the press and public be excluded from the meeting for items 5, 6 and 7 on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 1 and 2 Part I of Schedule 12A of the Act.

Application for Consent to Amend Street Trading Licence (Mr NC)

To consider the report of the Assistant Director Environment.

Councillor Harvey declared a disclosable personal interest and left the meeting during consideration of this item.

 

The Environmental Health and Licensing Manager presented an application for consent to street trade for a period of twelve months in Castle Street (adjacent to High Street), Exeter, which was a designated Consent Street under the provisions of the Local Government Act 1982.

 

Mr C currently held a consent to trade in Castle Street selling hot pies and pasties, fudge and ice cream, from a 6ft by 4ft stall. Mr C proposed to upgrade and modernise his current stall by replacing it with a specifically adapted, fully electric vehicle. The new vehicle would offer an improved and upgraded catering environment from which to trade, including a fully integrated gas boiler and ovens, and would offer a visual upgrade on his present stall. The proposed electric vehicle would be 9ft 8inches long (3m), by 4ft 6inches wide (1.4m). The main increase in the length of the pitch would be due to the cab of the vehicle and, as such, the total trading area would remain broadly similar to at present. Mr C proposed to park the vehicle in the same location as his current stall.

 

The times and days requested were a continuation of the existing times from 09:30 hours to 18:30 hours, Monday to Saturday.

 

Mr C attended and spoke in support of his application. 

 

A letter of support had been received from the operator of the The Creperie, also located in Castle Street

 

The Committee retired to make its decision in the presence of the Democratic Services Officer only.

 

RESOLVED that street trading consent be granted for a period of twelve months, subject to the conditions set out in the report.

Application for Consent to Street Trade (SB)

To consider the report of the Assistant Director Environment.

The Environmental Health and Licensing Manager presented an application for consent to street trade from Ms B for a period of twelve months in Exeter under a roving consent license in order to trade at various locations, primarily in Marsh Barton and Sowton. Ms B proposed to retail hot and cold food, all food preparation to be undertaken at the dedicated production unit in Taunton with the van undertaking the retail only.

 

Ms B and colleague attended and spoke in support of his application.

 

The Committee retired to make its decision in the presence of the Democratic Services Officer only.

 

RESOLVED that street trading consent be granted for a period of twelve months, subject to the conditions set out in the report.

Application for Consent to Street Trade (LH)

To consider the report of the Assistant Director Environment.

The Environmental Health and Licensing Manager presented an application for consent to street trade from Ms H for a period of six months in Exeter under a roving consent licence, trading at various locations, primarily in Marsh Barton and Sowton. Ms H proposed to operate a lunch delivery service providing healthy salads, root brownies, crisps and drinks. All food preparation would be undertaken in advance at the dedicated production unit/studio at 25 Manor Road, Exeter, with the truck used for undertaking retail only.

 

Ms H did not attend.

 

The Committee retired to make its decision in the presence of the Democratic Services Officer only.

 

RESOLVED that street trading consent be granted for a period of six months, subject to the conditions set out in the report.
