Appointment of Chair

To appoint a Chair for the meeting.

 

Minutes:

Councillor Shiel was appointed Chair for this meeting.

 

5.

Declarations of Interest

Councillors are reminded of the need to declare any disclosable pecuniary interests that relate to business on the agenda and which have not already been included in the register of interests, before any discussion takes place on the item. Unless the interest is sensitive, you must also disclose the nature of the interest. In accordance with the Council's Code of Conduct, you must then leave the room and must not participate in any further discussion of the item.  Councillors requiring clarification should seek the advice of the Monitoring Officer prior to the day of the meeting.

Application for the renewal of a Private Hire Vehicle Over 8 Years Old (Mr AHG) pdf icon PDF 57 KB

The Solicitor introduced the Sub-Committee and set out the procedure for the hearing advising of the Council’s policy and the requirements under Section 48(1) of the Local Government (Miscellaneous Provisions) Act 1976.

 

The Senior Licensing Officer presented an application from Mr AHG to renew a Private Hire Vehicle licence in relation to a vehicle which was over eight years old.

 

The applicant was invited to set out the scope of his work and also provide an outline of the service history of the car.

 

Mr G spoke in support of the application and stated that his company, Sowton and Topsham Cars, had introduced bi-monthly inspection of all its cars.

 

 

RESOLVED that the application for the renewal of a Private Hire Vehicle licence for a vehicle which was over eight years old, be approved for a period of 12 months.

Application for the grant of a Private Hire Vehicle over four years old (Mr WC)

To consider the report of the Assistant Director Environment.

The Solicitor introduced the Sub-Committee and set out the procedure for the hearing advising of the Council’s policy and the requirements under Section 48(1) of the Local Government (Miscellaneous Provisions) Act 1976.

 

The Senior Licensing Officer presented an application from Mr WC to grant a Private Hire Vehicle Licence in relation to a vehicle which was over four years old. It was noted that, due to confusion with the applicant changing address and paperwork not being received by the applicant, the vehicle had not been re-licensed on the renewal date.

 

Mr C spoke in support of the application.

 

RESOLVED that the application for the grant of a Private Hire Vehicle licence for a vehicle which was over four years old, be approved.

 

 

8.

LOCAL GOVERNMENT (ACCESS TO INFORMATION) ACT 1985 EXCLUSION OF PRESS AND PUBLIC

To pass the following resolution:

RESOLVED that, under Section 100A (4) of the Local Government Act 1972, the press excluded from the meeting for item 6 on the grounds that it involves the likely disclosure of exempt information as defined in paragraphs 1 and 2 of Part I of Schedule 12A of the Act.

RESOLVED that, under Section 100A (4) of the Local Government Act 1972, the press and public be excluded from the meeting for the consideration of the following item on the grounds that it involved the likely disclosure of exempt information as defined in Paragraphs 1 and 2 of Part I, Schedule 12A of the Act.

To determine if the applicant is a fit and proper person to hold a taxi drivers licence under the relevant legislation

The Chair introduced the Sub Committee.

 

The Solicitor introduced the Officers and set out the procedure for the hearing advising of the Council’s policy objectives under paragraph 1.2 and the Code of Conduct for Licensed Drivers.  The Solicitor explained that Section 51 of the Local Government (Miscellaneous Provisions) Act 1976 stated that before granting a drivers licence the Licensing Authority must be satisfied that the driver is a fit and proper person to hold a drivers licence.

 

The Senior Licensing Officer presented the report and gave evidence in respect of the application.

 

Mr GS attended the meeting and spoke in support of himself reiterating the points made in his written statement to the Sub-Committee. 

 

The Sub Committee retired to make its decision in the presence of the Solicitor and the Democratic Services Officer (Committees) (HB)

 

RESOLVED that the Licensing Sub-Committee found Mr GS to be a fit and proper person to drive a hackney carriage or private hire vehicle and that the licence be granted for a period of twelve months.
