Councillor Holland was appointed as the Chair for this meeting.

The Chair introduced the Sub-Committee and the Solicitor set out the procedure for the hearing advising of the Council’s policy and the requirements under Section 48(1) of the Local Government (Miscellaneous Provisions) Act 1976.

 

The Principal Licensing Officer presented the report stating that the vehicle was a four seater Skoda Octavia, registration FX63 MUU, which is currently licenced by East Devon District Council as a Hackney Carriage vehicle and has been since 26 September 2013, making the vehicle over four years old, with 101,020 miles recorded. The application could not be dealt with under delegated powers. The Applicant having obtained a dual drivers licence with Exeter City Council wished Exeter to Licence the vehicle in Exeter as a Private Hire Vehicle.

 

The vehicle had been MOT tested on 16 May 2018, containing one advisory concerned with the brake pads. The vehicle had also received an independent mechanical inspection on 16 May 2018 and inspected by the Licensing Authority on 22 May 2018, who considered it to be in very good condition.

 

The Applicant was in attendance, with a colleague and spoke in support of the application. He explained that he had owned the vehicle since 2016, which he considered to be in excellent condition. Although the vehicle is licensed by East Devon District Council as a Hackney Carriage most of his work is in Exeter. The Applicant operated in a local capacity, making runs to the airport and surrounding areas. The advisory work for the brake pads had been completed and the Applicant would supply the proof to the Principal Licensing Officer, to confirm that the work had been completed. The Applicant explained the vehicles mileage was related to both business and private use and that the car was serviced every 8-10,000 miles.

 

RESOLVED that the application for a Private Hire Vehicle licence for a vehicle which was over 4 years old be approved for 12 Months.

LOCAL GOVERNMENT (ACCESS TO INFORMATION) ACT 1985 EXCLUSION OF PRESS AND PUBLIC

To pass the following resolution:

 

RESOLVED that, under Section 100A (4) of the Local Government Act 1972, the press and public be excluded from the meeting for items 5 on the grounds that they involve the likely disclosure of exempt information as defined in paragraphs 1, 2 and 3 of Part I of Schedule 12A of the Act.

Application to Grant of a licence relating to a Hackney Carriage vehicle

The Chair introduced the Sub-Committee and the Solicitor set out the procedure for the hearing advising of the Council’s policy and the requirements under Section 48(1) of the Local Government (Miscellaneous Provisions) Act 1976.

 

The Principal Licensing Officer presented the report from an existing licensed taxi driver who was seeking permission for the grant of a Hackney carriage vehicle licence.

 

The Applicant was in attendance and spoke in support of his application.

 

RESOLVED that the application be approved in principle and delegation be made to the Principal Licensing Officer to grant the Vehicle Licence in compliance with the Council’s Practises and Procedures for the Control of Hackney Carriage and Private Hire Vehicles Drivers and Operators upon receipt by the Licensing Authority of full vehicle details and a comprehensive mechanical inspection report.
