Councillor Holland was appointed as the Chair for this meeting.

The Chair introduced the Sub-Committee and the Solicitor set out the procedure for the hearing advising of the Council’s policy and the requirements under Section 48(1) of the Local Government (Miscellaneous Provisions) Act 1976.

 

The Senior Licensing Officer presented an application from Mr JC to grant a Private Hire Vehicle licence in relation to a vehicle which was over 9 years old at the renewal date advising that the matter could not be dealt with under delegated powers. She explained that the vehicle had been licensed as a private hire vehicle since 2011, and the registration date was 24th September 2008 making the vehicle over 9 years old at the time of renewal. The policy in place for the renewal of private hire vehicles between 9 and 10 years old, stated that they would need to be referred to the Licensing Sub-Committee for determination.

 

The vehicle’s recorded mileage from the latest MOT on 21st November 2017, was 186,084 miles. The MOT certificate provided contained one advisory on surface rust to the nearside and offside rear floor area. The vehicle was inspected by an independent vehicle inspector on 21st November 2017 and by a Licensing Officer on 28th November 2017, and considered to be in very good condition.

 

Mr JC was in attendance and spoke in support of the application. He explained that he had owned the vehicle for three years, which was used for shorter journeys around the city with occasional longer distances which he was the only driver. He explained that the vehicle was serviced every 10,000 miles and that the surface rust was not a structural issue. He confirmed that he was aware of the Council’s Policy to refuse vehicles over 10 years of age except in exceptional circumstances and would be looking at getting a new vehicle within the next year.

 

RESOLVED that the application for the renewal of a Private Hire Vehicle licence for a vehicle which was over 9 years old be approved for 12 Months.

She explained that the vehicle had been licensed as a private hire vehicle since 2010, and the registration date was 28th April 2008 making the vehicle over 9 years old at the time of renewal. The policy in place for the renewal of private hire vehicles between 9 and 10 years old, stated that they would need to be referred to the Licensing Sub-Committee for determination.

 

The vehicle’s recorded mileage from the latest MOT on 23rd November 2017, was 284,999 miles. The MOT certificate provided contained two advisories and had been inspected by an independent vehicle inspector on 23rd November 2017 and by a Licensing Officer on 30th November 2017, and considered to be in very good condition.

 

Mr AP attended on behalf of Mr ZO as manager of Z Cars and spoke in support of the application. He explained that the vehicle was a company vehicle, used by one driver which was a wheelchair accessible. It was used to pick up wheelchair and elderly customers. It was kept in good condition with positive feedback from customers. The vehicle was used in both week days and weekends, with an increase in evening pickups. The vehicle was serviced every 10,000 miles which the advisories would be addressed.

 

RESOLVED that the application for the renewal of a Private Hire Vehicle licence for a vehicle which was over 9 years old be approved for 12 months,

 

Advisory Note:  The Committee advised the Applicant to ensure thesuspension advisory on the MOT be checked at the vehicles next service and that the Council’s Policy was not to renew licences for vehicles over 10 years old unless there were exceptional circumstances.
