Councillor Buswell was appointed as Chair for this meeting.

The Chair introduced the Members of the Sub-Committee together with the Legal Advisor, the Principal Licensing Officer and the Democratic Services Officers. The Legal Advisor set out the hearing procedure and the Applicant and Respondents who were in attendance, agreed that the procedure was understood.

 

The Licensing Officer presented the application received from the Devon and Cornwall Police, who had sought a review of the Premises licence in respect of The Queens Head Hotel (Exeter) Ltd ](‘the Licence Holder’) at The Queens Head Hotel, 270 Pinhoe Road, Exeter, EX4 7JQ (‘the Premises’. The application had been advertised and circulated as required by the legislation and had been completed on 13 April 2020.

 

An Application notice was placed in close proximity to the premises and on the Exeter City Council website on 24 April 2020. The notice was also circulated to responsible authorities and served on the Licence Holder. Representations were received from an interested party, Devon and Cornwall Constabulary, as the applicant and one from Environmental Health as a responsible authority.

 

A request was made from the Respondent’s Solicitor concerning issues with the Application in regards to legislation. The Licensing Sub-Committee considered three preliminary points raised by the Respondents Solicitor and made the following determination. 

 

RESOLVED: that the Application to Review the Premises Licence on the grounds of Public Safety be rejected.
