Appointment of Chair

To appoint a Chair for the meeting.

 

Minutes:

Councillor Peter Holland was appointed as Chair for this meeting.

Declarations of Interest

Councillors are reminded of the need to declare any disclosable pecuniary interests that relate to business on the agenda and which have not already been included in the register of interests, before any discussion takes place on the item. Unless the interest is sensitive, you must also disclose the nature of the interest. In accordance with the Council's Code of Conduct, you must then leave the room and must not participate in any further discussion of the item.  Councillors requiring clarification should seek the advice of the Monitoring Officer prior to the day of the meeting.

LOCAL GOVERNMENT (ACCESS TO INFORMATION) ACT 1985 EXCLUSION OF PRESS AND PUBLIC

It is considered unlikely that the Committee would wish to exclude the press and public during consideration of the items on this agenda.  If, however, the Committee were to exclude the press and public, a resolution in the following form should be passed:

 

“RECOMMENDED that, under Section 100A (4) of the Local Government Act 1972, the press and public be excluded from the meeting for the particular item(s) on the grounds that it (they) involve the likely disclosure of exempt information as defined in paragraph(s) of Part I of Schedule 12A of the Act.”

The Chair introduced the Licensing Sub-Committee Members and Officers. The Apprentice Solicitor set out the legislation and procedure for the hearing and the Applicant who was in attendance with a representative from Devon Wildlife Trust, confirmed that the procedure was understood.

 

In response to a question from the Apprentice Solicitor the Licensing Officer advised in respect of the use of a petrol generator and how the Assessment Framework Matrix had been completed.

 

The Licensing Officer, presented the report which advised the Applicant was seeking the approval of the Licensing Sub-Committee for a roving street trading consent for a roaming horsebox trailer in the Valley Parks and one other site in Prince Charles Road. The Applicant had applied for a 3-month licence to trade Monday to Sunday, between 06:00 and 19:00 hours, giving the applicant scope to test the best location and trading times daily.

 

The Applicant had submitted photographs of their trailer, generator, and the proposed pitch areas, which were included in the report papers.

 

The Applicant spoke in support of the application, making reference to:-

  • her previous experience within the hospitality and catering industry;
  • the community surrounding Mincinglake Valley Park; and
  • how this would be a provision of a much-wanted service within Mincinglake Valley Park.

 

In response to questions from the Members, the Apprentice Solicitor and the Licensing Officer, the Applicant clarified that: -

 

  • a new low operational noise generator would be used and would not be running constantly;
  • water would be brought from home in large 25 litre containers;
  • a bin would be provided outside the trailer, and a waste contract is in place that separates the waste;
  • the Applicant would offer a discount for any members of the public that provide their own reusable coffee cup;
  • none of the cakes and snack provided would be wrapped in single use plastic;
  • there would be a trial of both sides of Mincinglake Valley Park to identify the best location with minimal disruption to other users; and
  • if a comfort break is needed, the Applicant would close the trailer and use their own facilities at home as they lived locally.

 

Members, having considered the Application, noted that the application was for three months only to provide an opportunity to scope out the best trading times and locations, and that any future application for an extension should set out a more specific location.

 

RESOLVED that the application would be approved, subject to the conditions set out in section 15 of Exeter City Council’s Street Trading Policy 2024.

The Chair introduced the Licensing Sub-Committee Members and Officers. The Apprentice Solicitor set out the legislation and procedure for the hearing and the Applicant who was in attendance, confirmed that the procedure was understood.

 

In response to a question from the Apprentice Solicitor the Licensing Officer advised in respect of the use of a diesel generator and how the Assessment Framework Matrix had been completed.

 

The Licensing Officer, presented the report which advised the Applicants were seeking the approval of the Licensing Sub-Committee for a roving street trading consent applicable to a roving jiffy van. The Applicant had applied for a 12-month licence to trade Monday to Sunday, between 06:30 and 16:00 hours.

 

The Applicant submitted photographs of their van and generator, as well as a list of proposed pitch areas, which were included in the report papers.

 

The Applicant spoke in support of the application, making reference to

  • his previous experience working in the hospitality industry for 24 years; and
  • trading as set out in the Application would enable him to spend more time with his family.

 

In response to questions from the Members, the Apprentice Solicitor, and the Licensing Officer, the Applicant clarified that:-

  • there was an established, repeat customer base;
  • an app can be used by his customers to track his arrival at certain locations, meaning that he does not have to wait for long periods of time at the same site;
  • the sandwiches provided are made by a company in Bristol; and
  • he is registered as a lower tier waste carrier already, and gives his coffee grounds to a local farm as compost.

 

Members, having considered the application, noted that use of a generator would cause limited nuisance due to the short time at each location within the car parks of commercial units on industrial estates.

 

RESOLVED that the application would be approved, subject to conditions set out in section 15 of Exeter City Council’s Street Trading Policy 2024.

 

10.

Both applicants for Item 6 on the agenda were present to hear the legislation and procedure as more than one application had been received for the same site at Castle Street. The Chair introduced the Licensing Sub-Committee Members and Officers. The Apprentice Solicitor set out the legislation and procedure for the hearing, and both Applicants confirmed that the procedure was understood. 

 

The second Applicant withdrew from the room whilst the first application was heard.

 

First Application

 

The Licensing Officer presented the application which sought the approval of the Licensing Sub-Committee for a street trading consent for Castle Street, Exeter, to sell a range of Greek food from a gazebo staff.  The Applicant had applied for a consent to trade for 12 months, Monday to Sunday between 9:00 and 16:00.

 

The Applicant had submitted photographs of their gazebo, food packaging, menu, and proposed pitch area which were included at Appendices B and D.

 

The Applicant spoke in support of the application, making reference to:-

  • his experience with his current Greek takeaway in Buddle Lane; and
  • the satisfaction of his existing customers.

 

In response to questions from the Members, the Apprentice Solicitor, and the Licensing officer, the Applicant clarified that: -

 

  • a covered bin would be used to deter seagulls;
  • all food apart from chicken and fries would be pre-prepared in the Buddle Lane shop and then stored in thermal bags with ice within the gazebo;
  • vegetarian options would be available, but not currently vegan, but it is being seriously considered due to customer demand; and
  • it was confirmed that the gazebo would be secured with four large weights.
  • He had no concerns regarding the Assessment Framework Matrix prepared by the Licensing Officer

 

The first Applicant withdrew from the room and the Second Applicant returned.

 

Second Application

 

The Licensing Officer presented the application which sought the approval for a stationary trailer, to sell falafel, salad, and wraps on Castle Street. The Applicant had applied for a 12-month licence to trade Monday to Sunday between 10:00 and 18:00.

 

The Applicant provided photographs of their trailer, and the proposed pitch area was included in the report papers.

The Applicant spoke in support of the application, making reference to his experience with catering, and that he was confident with this particular trade as he had worked in a similar role with his father for a long time.

 

In response to questions from the Members, the Apprentice Solicitor and the Licensing Officer, the Applicant clarified that:

  • he had completed his Level 2 Food Hygiene in May 2025;
  • the food would be prepared at home and an application to register with Environmental Health as a food business would be submitted if the licence was granted and will not trade until inspected;
  • public Liability Insurance will be obtained if the licence was granted;
  • a bin with a secure lid would be used, and the area would be kept tidy;
