Application for a Hackney Carriage/Private Hire Driver's Licence (Mr R.L.J.V.) To consider the report of the Head of Environmental Health Services.

Minutes: The Principal Licensing Officer presented an application from a Mr V, an applicant for a licence to drive a Hackney Carriage or Private Hire Vehicle. Mr V had failed to disclose two convictions on his application form which had been later disclosed on his Criminal Records Bureau [CRB] check. The convictions were a two year disqualification for driving with excess alcohol in 1988 and a traffic signal offence in December 2006. The latter offence, if identified in isolation, would normally have been dealt with under delegated powers.
As part of the application process Mr V had been asked to sign a declaration on the application form at section 3, identifying whether or not he had ever been convicted of a criminal offence or received a caution, reprimand or warning. Mr V had struck through “‘yes” and signed the application form. He had also signed a declaration stating that he had checked the answers and that to the best of his knowledge and belief the answers are correct. Mr V had been asked by the licensing officer who was completing the form if he had any convictions or cautions to declare and to sign a declaration in the relevant section identifying his response in the YES or NO box. Mr Vaughan ticked ‘no’ and signed the CRB form.
Mr Vaughan had submitted a letter dated 7 October 2010 explaining the reasons for not declaring his conviction and cautions.
Mr V attended the meeting and spoke in support of his application. He stated that
The Sub Committee retired to make its decision in the presence of the Licensing Solicitor and the Member Services Officer.
RESOLVED that the application for a licence to drive a Hackney Carriage or Private Hire Vehicle be granted subject to a warning as to his future conduct
