Councillors are reminded of the need to declare any disclosable pecuniary interests that relate to business on the agenda and which have not already been included in the register of interests, before any discussion takes place on the item. The Chair introduced the Members of the Licensing Sub-Committee together with the Legal Advisor, the Service Lead - Environmental Health and Community Safety and the Democratic Services Officers. The Legal Advisor set out the hearing procedure and the Applicants, who were in attendance, agreed that the procedure was understood. One speaker making representations on the application was also in attendance.

 

The Service Lead Environmental Health & Community Safety presented the application to grant a new premises license at the Heavitree Social Club, 2 East Wonford Hill, Exeter, Devon, EX1 3BS. It was confirmed that there had been 14 representations received which was included in the agenda documentation and were relevant to the Licensing Objective for the Prevention of Public Nuisance.

 

The Applicant had sought to apply for the provisions detailed in the report and had submitted an agreed a set of conditions with Devon and Cornwall Constabulary to promote the licensing objectives and it was confirmed that the application had been advertised on the premises from 16th April 2021 and in the local newspaper on 22nd April 2021, in accordance with the requirements of the Licensing Act 2003. The end date for representations was on 13th May 2021.

 

The Service Lead Environmental Health & Community Safety confirmed that the Applicant held a current Club Premises Certificate, and had submitted 104 emails of support for the Application, which were included as part of the report documents presented at the meeting.

 

The Applicant spoke in support of their application and responded to questions from Members and the Legal Advisor. Particular reference was made to the removal of the provisions of live and recorded outside music. The objector in attendance made representations against the application. Members considered the application and representations received.

 

RESOLVED: that the application be granted as applied for, subject to conditions for the reasons set out in the formal decision notice attached.
