Minutes:

Councillor Holland was appointed as Chair for this meeting.

Declarations of Interest

Councillors are reminded of the need to declare any disclosable pecuniary interests that relate to business on the agenda and which have not already been included in the register of interests, before any discussion takes place on the item. Unless the interest is sensitive, you must also disclose the nature of the interest. The Chair introduced the Members of the Sub-Committee together with the Legal Advisor, Apprentice Solicitor, the Licensing Officer and the Democratic Services Officer. The Apprentice Solicitor set out the hearing procedure and all parties in attendance, agreed that the procedure was understood. The Apprentice Solicitor confirmed with the Applicant that they had received a copy of the representation made.   

 

The Licensing Officer presented the application which sought the variation of a premises licence.  The application has been advertised on the premises for 28 days and in the local newspaper on 8 February 2024 as required by legislation. The last date for representations was 7 March 2024 and one representation had been received from a local resident.

 

The variation sought to:-

 

  • include a new bar to be situated in the gardens as shown on submitted plans,
  • for the hours of the sale of alcohol from the new bar to be the same as the current hours permitted for the sale of alcohol on the premises of 10.00 to 00:00 Monday to Sunday and from 10.00 on New Years Eve to 10.00 on New Years Day.

·         the Applicant also sought the sale of alcohol to be both on and off the premises, and.

·         all other timings, licensable activities and plans of the public house to remain as existing.

 

The representation from a local resident objecting to the variation relating to the following Licensing Objectives:

 

·         the Prevention of Public Nuisance, and

·         the Protection of Children from Harm. 

 

The respondent was not in attendance. There were no other representations from any of the other Responsible Authorities.

 

The Applicant was in attendance, with a legal representative and a representative from St Austell Brewery who all spoke in support of the application and responded to questions from Members, and the Legal Advisor. It was noted that the variation had been requested as part of a wider refurbishment of the premises including the beer garden.

 

The Licensing Officer read out the written representation together with additional documentation. The Applicant responded to the concerns raised by the representation. 

 

The meeting was closed so that the Members could determine the application.

 

RESOLVED that the application to vary the licence was granted for the reasons set out in the formal decision notice attached.
