Appointment of Chair

To appoint a Chair for the meeting.

 

Minutes:

Councillor Snow was appointed as Chair for this meeting.

Declarations of Interest

Councillors are reminded of the need to declare any disclosable pecuniary interests that relate to business on the agenda and which have not already been included in the register of interests, before any discussion takes place on the item. Unless the interest is sensitive, you must also disclose the nature of the interest. In accordance with the Council's Code of Conduct, you must then leave the room and must not participate in any further discussion of the item.  Councillors requiring clarification should seek the advice of the Monitoring Officer prior to the day of the meeting.

The Chair introduced the Members of Licensing Sub-Committee together with the Legal Advisor, Apprentice Solicitor, Principal Licensing Officer, Licensing Officer, Democratic Services Officer and Assistant Democratic Services Officer.  The Legal Advisor set out the hearing procedure and the Applicant, who was in attendance, agreed that the procedure was understood.

 

The Licensing Officer presented the application to seek a variation of the premises licence for The Duke of York Inn, 58 Sidwell Street, Exeter, EX4 6PH as set out in the report.

 

The application included existing and proposed licensing provisions.

 

It was confirmed that fourrelevant representations objecting to the variation relating to the Licensing Objectives had been received. The representations were listed in an appendix to the report.  No representations had been received from any Responsible Authorities.

 

It was confirmed that the application was advertised on the Premises and in the local newspaper in accordance with the requirements of the legislation, with the last date for representations being 13 March 2025.

 

The Applicant spoke in support of their application and responded to questions from Members and the Legal Officers.

 

A member of the public spoke on their representation objecting to the application.

 

Members confirmed that they had read all four representations attached to the agenda and these would be considered when determining the application.

 

The Applicant and representative were given the opportunity to sum up.

 

All parties present were advised that a decision notice would be issued within five working days of the hearing.

 

The meeting was closed so that the Members could determine the application.

 

RESOLVED that the application be granted as applied for, subject to conditions for reasons set out in the formal decision notice.
