The Chair introduced the Members of the Licensing Sub-Committee together with the Legal Advisor, the Principal Licensing Officer, the Licensing Officer and the Democratic Services Officer. The Legal Advisor set out the hearing procedure and the parties in attendance, agreed that the procedure was understood.

 

The Principal Licensing Officer presented the application to vary a premises license at The Star Inn, 68 Whipton Village Road, Whipton, Exeter, EX4 8AW. It was confirmed that there had been two representations received, which were included in the agenda documentation and were relevant to the licensing objectives of the prevention of public nuisance, the prevention of crime and disorder and public safety. Members noted that representations from Exeter City Council’s Environmental Health and Community Safety Manager related to recorded complaints at the Premises and that the Alcohol Licensing Officer from Devon and Cornwall Constabulary had forwarded representations which sets out proposed conditions.

 

The Principal Licensing Officer confirmed that the Application had been advertised on the premises and in the local newspaper, in accordance with the requirements of the Licensing Act 2003 and that the end date for representations was 22 February 2022.

 

The Application was seeking to extend the licensable area of the premises to include an outside area with an external bar and seating to permit on sales of alcohol, and adding three addition conditions to the outside area when carrying out licensable activities and to replace an existing condition. If the existing condition was replaced three conditions on the existing licence would need to be amended.

 

The Applicants were accompanied by a legal representative and spoke in support of their Application and responded to questions from Members and the Legal Advisor.

 

The Environmental Health and Community Safety Manager spoke in support of the Environmental Health representation and responded to questions from Members and the Legal Advisor.

 

The parties were given the opportunity to sum up their submissions.

 

The meeting was closed so that the Members could determine the application.

 

RESOLVED that the application be granted as applied for, subject to conditions and for the reasons set out in the formal decision notice attached.
