Under the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012, Regulation 5 Paragraph 6 states:-
Where the date by which a meeting must be held makes compliance with the legislation requirment for 28 days notice of an item being considered in private is impracticable, the meeting may only be held in private where the decision-making body has obtained agreement from the chairman of the relevant overview and scrutiny committee that the meeting is urgent and cannot reasonably be deferred
.
Agreement had been sought from the Chair of the Customer Focus Scrutiny Committee and the Deputy Leader and Portfolio Holder for Council Housing Development and Services.
